What are the South Dakota food safety regulations?

You can find the entire Food Service Code on the South Dakota Legislature’s website. Within the code, are the requirements for persons-in-charge and food service manager certifications. Here’s a short overview to help summarize the requirements:

Person-in-Charge

Each food service establishments must designate a “person-in-charge”. This can either be the license holder or someone else that oversees food service operations. Additionally, there must be a person-in-charge available for each shift while the establishment is open. And this person must be a certified food manager. Only temporary establishments are exempt from this requirement.

Food Service Manager Certification

To become a certified food service manager, you must:

  1. Have a minimum of eight hours of classroom instruction (either in-person or online)
  2. Passed a certifying test from an approved food service manager certification program

How long is the food manager certification good for?

Your food service manager certification expires every four years. Once that time is up, you must complete at least four hours of instruction and pass the certified food service manager test again.

What can food managers improve food safety?

Foodborne illness is a serious danger throughout the United States, including South Dakota. According to data from the Center for Science in the Public Interest, over a 10-year period (2003-2012), there were a total of 15 foodborne illness outbreaks. And the two most common pathogen found were Salmonella and Clostridium—both preventable with the right food safety protocols in place.

Since food managers in South Dakota can have many different job titles, they have a host of responsibilities that include everything from people managing to customer service. However, the one thing every food manager has in common, no matter their job title, is food safety.

And as a person-in-charge, the rules in South Dakota state that food service managers are responsible for a variety of food safety measures, such as:

  • Keeping unauthorized persons out of areas dedicated to food preparation, storage, and ware-washing, and ensuring that anyone who is authorized to be in these areas follows the rules listed in the Food Service Code.
  • Employees are demonstrating proper techniques for hand washing, food storage, cooking temperatures, rapid food cooling methods, and cleaning and sanitization.
  • Informing customers who order raw or partially cooked foods of animal origin that their food is not cooked sufficiently to ensure its safety.
